Privacy Notice For Indivicuals
This Privacy Notice complies with the Personal Data in possession of individuals Protection Federal Law, which can be consulted, among others, at the Federal Institute of Access to Information and Data Protection (IFAI) through its website: www.ifai.org.mx , published on July 5, 2010 in the Federation Official Gazette. It is applicable to any information concerning the identified or identifiable person (hereinafter “Personal Data”) of the Holders;
– Personal data obtained from a physical person acting in his or her own right.
– Personal data collected from a physical person acting on behalf of a moral person.
Which, for any reason, are in the possession of AGF PRODUCCIONES S.A. DE C.V. including its partners, employees, contractors, customers and suppliers (hereinafter collectively and indistinctly “AGF PRODUCCIONES S.A. DE C.V.”).
AGF PRODUCCIONES S.A. DE C.V.: (i) is committed to safeguard the personal data confidentiality (including, if applicable, data considered as sensitive); (ii) may or may not maintain databases, and/or keep information and/or Personal Data in electronic or physical files, access to which is restricted exclusively to AGF PRODUCCIONES S.A. DE C.V.; and (iii) has ensured that its files and records have administrative, technical and physical security measures that allow the protection of data against damage, loss, alteration, destruction or unauthorized use, access or processing, which ensures that privacy and confidentiality are always protected in terms of law.
This Notice details the Personal Data treatment and transfer of, as well as the measures adopted by AGF PRODUCCIONES SA DE CV for Personal Data protection.
The personal data that AGF PRODUCCIONES SA DE CV may collect, depending on each particular case, and that it uses for its purposes are as follows:
– Identification data; Name, Marital Status, Age.
– Federal Taxpayers Registry (RFC)
– Unique Population registry code (CURP)
– Place and date of birth
– Nationality
– Contact information; Address, Home phone number, cell phone number, e mail address
– Interbank account number
– Photograph
– Migratory data; passport number, entries and exits of the country, time of permanence in the country, migratory quality.
The Personal Data that AGF PRODUCCIONES S.A. DE C.V. requires to obtain from the Data Controllers as well as its use, disclosure, handling, storage, transfer, use, data disposal or any access action (hereinafter jointly referred to as “Processing”), will be used exclusively for the activities related to the On Set, Digital Laboratory, Administrative and/or Commercial services required by the Data Subject as well as to ensure compliance with the laws and other regulations governing the activities and services provided by AGF PRODUCCIONES S.A. DE C.V. and may be required by the Data Controller.
Furthermore, AGF PRODUCCIONES SA DE CV may disclose or transfer personal data to authorities in the exercise of their functions, or if any law or any legal process requires it.
The Owners have the right at any time to: i) access to the Personal Data in possession of AGF PRODUCCIONES SA DE CV; ii) rectify them when they are inaccurate or incomplete, as long as it is not impossible or requires unreasonable efforts; iii) cancel their data, unless it could cause damages to third parties or in the cases provided by the Law, iv) limit the use of the same to exclusive activities that the owner of them so states; and v) be opposed to the Processing of the same for legitimate reasons.
The Owners or legal representatives may exercise the rights of access, rectification, cancellation, consent revocation and Opposition (ARCO) indicated in the Law, by means of a letter addressed to AGF PRODUCCIONES SA DE CV, which must contain as follows:
1. Name, address and any other information means to communicate the answer.
2. Documents that certify the identity of the Holder and legal representative, if applicable.
3. Clear and precise description of the Personal Data on which it seeks to exercise any of the rights mentioned in the Law.
4. Any other element or document that facilitates the identification and location of the Personal Data.
5. For rectification requests, you must indicate the modifications to be made and provide the documentation supporting your request.
AGF PRODUCCIONES SA DE CV will communicate to the Holder, within a term no longer than 20 calendar days, counted from the date of reception of the corresponding request, the adopted determination. In case it is applicable, it will be effective within 15 calendar days following the date on which the answer is communicated.
In case of personal data applications, the delivery will be made prior accreditation of the identification of the applicant or legal representative, as appropriate. The delivery of the Personal Data shall be free of charge, and the Data Subject shall cover the shipping costs or the cost of reproduction in copies.
